These Terms & Conditions (“T&C”) govern your use of the EB Painting website, services, and any associated quotations or agreements (“Services”). By accessing the website or hiring EB Painting, you agree to be bound by these T&C. If you do not agree, please discontinue use of the website and services.
EB Painting (“we”, “our”, “us”) reserves the right to update or modify these T&C at any time without prior notice. Continued use of the website or services after such changes constitutes acceptance of the revised T&C.

1. Eligibility & Use of Website

1. You must be at least 18 years old to request quotes, book services, or enter into agreements with EB Painting.

2. By using the website, you agree not to engage in any unlawful or unauthorized activities, including attempting to access restricted information or interfering with the website’s functionality.
    

2. Service Estimates & Pricing

1. All quotes provided—whether in person, online, or via message—are estimates based on the information available at the time.

2. Final pricing may change due to:

   • Unforeseen surface conditions

   • Additional labour or materials requested

   • Changes in project scope

3. Any changes to scope or price will be communicated to you for approval before proceeding.

4. Estimates are valid for 30 days unless otherwise specified.
    

3. Booking, Deposits & Payment Terms

1. Booking a project may require a deposit, which will be applied to the final invoice.

2. Remaining balances must be paid upon completion unless otherwise agreed in writing.

3. Accepted payment methods include:

   • E-transfer

   • Credit card

   • Debit

   • Cash

4. Late payments may incur additional fees or interest as permitted by applicable law.
    

4. Cancellations & Rescheduling

1. Clients must provide at least 48 hours' notice for cancellations or rescheduling.

2. Deposits may be forfeited if cancellation occurs within 24 hours of the scheduled start time.

3. EB Painting reserves the right to reschedule work due to weather, material delays, emergencies, or safety concerns.
    

5. Project Responsibilities
5.1 Client Responsibilities
The client agrees to:

• Provide clear access to the work areas.

• Remove valuables, fragile items, and personal belongings prior to the start of work.

• Ensure pets and children are kept away from active work areas.

• Communicate any special considerations, allergies, or sensitivities to paint or dust.

5.2 EB Painting Responsibilities
We will:

• Perform all work professionally and safely.

• Use industry-standard materials unless otherwise specified.

• Protect your home and belongings to the best of our ability.

• Clean up the work area upon completion.

EB Painting is not responsible for pre-existing damages, inadequate home ventilation, or structural issues revealed during painting.

6. Colours, Finishes & Expectations

1. The client is responsible for final colour selection.

2. EB Painting is not liable for colour mismatch issues caused by:

   • Lighting differences

   • Previous coatings

   • Client changing their mind after final approval

3. Touch-up work after the final walkthrough may be subject to additional charges.
    

7. Warranty & Limitations

1. EB Painting offers a limited workmanship warranty on most interior and exterior projects. Warranty terms vary based on surface conditions and materials used.

2. Warranty does not cover:

   • Damage caused by moisture, leaks, or structural movement

   • Regular wear and tear

   • Damage caused by the client, other contractors, or unforeseen external factors

3. Materials are covered under the manufacturer’s warranty, if applicable.
    

8. Intellectual Property
All content on the EB Painting website—text, visuals, logo, branding, and digital assets—is the intellectual property of EB Painting and may not be copied, reproduced, or distributed without written consent.

9. Privacy & Data Protection
EB Painting may collect basic contact information for the purpose of providing estimates, scheduling work, or delivering services.
We do not sell, rent, or share personal information with third parties except where required to complete the service or comply with the law.

10. Limitation of Liability
To the fullest extent permitted by law, EB Painting is not liable for:

• Indirect or incidental damages

• Loss of profits

• Personal injury due to client negligence

• Issues arising from inaccurate or incomplete information provided by the client

Our total liability will not exceed the value of the service contract.

11. Termination of Services
EB Painting may suspend or terminate services at any time if:

• Unsafe working conditions are present

• The client engages in inappropriate or unlawful behaviour

• Payment terms are not met
   

12. Governing Law
These Terms & Conditions are governed by the laws of the Province of Ontario, Canada. Any disputes will be resolved in accordance with Ontario’s legal framework unless otherwise required by law.
